I have read and understood the entire clarification statement prepared by Eclit Bilişim Hizmetleri A.Ş.
(“ECLIT”) regarding the Law on the Protection of Personal Data No. 6698 and I have been informed about
ECLIT's processing of my Personal Data within the framework of the above-mentioned purposes.
In accordance with the Law on the Protection of Personal Data No. 6698 and in the light of the
information contained in the Clarification Statement, I hereby consent with my express approval
illuminated and informed in a way that leaves no room for hesitation, that ECLİT Bilişim Hizmetleri AŞ
can process my Personal Data through all channels, use this data to communicate with me, and share it
with the persons specified in the Clarification Statement in case of legal or actual requirements
related to the service and/or business relationship in order to preserve the necessary data in
accordance with the law; provide products/services to Eclit's Customers; procure products and/or
services from suppliers or manufacturers and/or establish and perform contracted or non-contractual
commercial relations in this regard; identify and control the parties signing the relevant documents;
record identity, address, tax number and other information for the identification the owner and
addressee of all kinds of applications, works and transactions to be carried out within the scope of
these; to arrange information and documents that will be the basis for works and transactions to be
carried out on paper or electronically.

End-User Agreement
This user agreement is a legal contract signed between the User and ECLIT IT SERVICES. By approving this
agreement, you agree to all its terms and conditions. The approval of this agreement is legally binding
for both parties.
ARTICLE I - GRANTING LICENSE
Under the terms of this agreement, ECLIT IT SERVICES provides the User with a non-exclusive license to
download and install. ECLIT IT SERVICES hereby also grants the User a non-exclusive license to use the
materials of ECLIT IT SERVICES. The User is obliged to use the software provided by ECLIT IT SERVICES
not on behalf of a third party, but for itself. The User cannot make amendments to the software. It is
strictly forbidden to perform reverse engineering, disassembling or trying to access the source code of
all or part of it.
Ownership: Confidentiality of Rights
By signing this agreement, the parties agree and confirm that ECLIT IT SERVICES is the sole and
exclusive owner of all intellectual and industrial rights and property mentioned herein and any related
financial interests.
Legal Use and Execution
The User is solely responsible for his execution and data on ECLIT IT SERVICES. The User hereby agrees
and undertakes to indemnify ECLIT IT SERVICES for all kinds of damages, costs and expenses arising from
the breach of this contract. The User also agrees and undertakes to use of the license in accordance
with the terms of the contract without causing any damage and to indemnify ECLIT IT SERVICES against any
violation of rights arising from the contract.
The User is responsible for complying with all prohibitions, rules and regulations by using this
software and not violating the rights of third parties. This product is provided by ECLIT IT SERVICES
only for the end-user, and the User may not in any way sell, distribute or rent the product to, or use
the product on behalf of third parties.
Data Collection and Confidentiality
The User agrees that ECLIT IT SERVICES can collect a limited amount of non-personally identifiable data
from their computer, such as backup frequency and backup completion time.
By signing this agreement, the User agrees that the product can collect data in accordance with the
Confidentiality Agreement on the ECLIT IT SERVICES website.
ECLIT IT SERVICES reserves the right to amend the content of this agreement without prior notice.
ARTICLE II - REPRESENTATION, WARRANTY AND LIMITS OF LIABILITY
General Warranty
The parties herein are obliged to comply with all the provisions set out in the agreement and fulfill
their contractual obligations. This agreement does not cover or bind any agreement that the parties may
sign with other third parties.
Waiver of Other Warranties
ECLIT IT SERVICES reserves the right to waive any warranties, whether oral or written, express or
implied, other than those declared in the “General Warranty” section of the agreement. The User is
personally responsible for any damages and discretions that may arise in case the user uses a
third-party service similar/parallel to ECLIT IT SERVICES.
Limits of Liability
ECLIT IT SERVICES, ITS SUPPLIERS, PARTNERS OR AGENTS SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR
INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES RELATED TO ECLIT IT SERVICES
AND FOR MATTERS NOT COVERED IN THIS AGREEMENT.
WITHOUT LIMITING THE FOREGOING STATEMENT, THE TOTAL LIABILITY THAT ECLIT IT SERVICES, ITS SUPPLIERS,
PARTNERS AND AGENTS WILL ASSUME UNDER ANY CIRCUMSTANCES MAY NOT EXCEED THE AMOUNT ACTUALLY PAID UNDER
THE CONTRACT. ECLIT IT SERVICES HAS NO OBLIGATION IF NO PAYMENT HAS BEEN RENDERED.
THE ABOVEMENTIONED RESTRICTIONS INCLUDE MISUSE, INABILITY TO USE THE ECLIT IT SERVICES SOFTWARE,
INTERRUPTION OR SUSPENSION OF SERVICE, TERMINATION OF THE SOFTWARE OR SERVICE (INCLUDING DAMAGES CAUSED
BY A THIRD PARTY). THIS LIMITATION ALSO HAS MAXIMUM VALIDITY, AS PERMITTED BY LAW, AGAINST ACTUAL
FAILURE OF USE.
SOME STATES AND JUDICIAL AUTHORITIES DO NOT ALLOW LIMITATIONS AND EXCLUSIONS TO BE APPLIED AGAINST
INCIDENTAL, CONSEQUENTIAL, AND DIRECT DAMAGES. IN SUCH A CASE, THE ABOVEMENTIONED LIMITATIONS AND
EXCLUSIONS CANNOT BE APPLIED.
ARTICLE III - MISCELLANEOUS
Termination and Resumption
If any of the parties fails to comply with one of the articles of this agreement, the other party has
the right to terminate the agreement. All the clauses in the agreement (except for force majeure) are
valid until the end of the agreement's validity period. The user may not use the provided passwords and
codes if the agreement is terminated.
Applicable Law
This agreement has been prepared in accordance with the laws of the Republic of Turkey.
Assignments
Users cannot become a party to this Agreement, whether directly or indirectly, without the written
permission of ECLIT IT SERVICES. Trademark, Service and Intellectual Properties: All trademarks, service
brands and other assets of ECLIT IT SERVICES belong to the right holder. The copyright and other
intellectual property rights of ECLIT IT SERVICES are protected by law. The User has agreed not to
damage or interfere with the rights of ECLIT IT SERVICES and its license provider.
Waiver
If either party do not use one or more of the provisions or rights in this agreement or fails to fulfill
its obligations, this cannot be interpreted as a waiver of these provisions.
Entire Agreement
As for the subject matter of this agreement, the terms and conditions written herein on this issue
constitute the entire agreement between the parties and replace all previous agreements and commitments
between the Parties on the same subject if any.
Partial Invalidity
The invalidity or voidness of any of the provisions presented in this agreement does not harm the
validity, legality and effectiveness of other articles.
Export Restrictions
By signing the agreement, the User agrees that ECLIT IT SERVICES is subject to the laws and restrictions
established under the “relevant” laws of the Republic of Turkey. The User declares and agrees that he
will not, whether directly or indirectly, transfer or re-export ECLIT IT SERVICES to any country and for
no purpose that is not permitted by law. The User is responsible for complying with the laws and
regulations regarding the use and encryption of ECLIT IT SERVICES in other countries. ECLIT IT SERVICES
disclaims any liability that may arise in such cases.
Third Party Acceptance
ECLIT IT SERVICES may develop third-party software and copyrighted materials. The approvals, license
agreements and additional disclaimers required for this purpose are governed by the relevant agreement.
